THE JURIDICAL IMPACT OF ARTIFICIAL INTELLIGENCE WITHIN BRAZILIAN LABOUR LAW

Abstract

This study aims to analyze the legal impacts that the use of artificial intelligence and automated decisions have had on Labor Law in Brazil. The innovation and advancement of Artificial Intelligence (AI) are undeniable and its use is beginning to become popular. Some problems also arise, especially in the social, economic and legal spheres, the latter being linked to labor law in the country and will be the focus of this work. Among the various issues that emerge with the increasing adoption of AI and automation, the impact on the labor market stands out, especially with regard to structural unemployment. The replacement of human functions by intelligent systems and autonomous machines has led to the elimination of jobs in various sectors, from industry to the service sector. This phenomenon creates challenges not only for workers who lose their jobs, but also for the legal system, which needs to adapt to this new reality. The need for professional retraining, the redefinition of employment relationships, and the responsibility of companies in the technological transition are topics that demand attention and regulation. Thus, this paper seeks to address the implications of AI for labor relations in Brazil, such as changes in employee control and supervision, automation of important functions, automated decisions, and the challenges in regulating these technologies, considering the Brazilian legal context, focusing on aspects such as the rules of the Labor Court versus reality. Present the possible known and expected positive or negative impacts, and present possible solutions to the legal problems encountered. The intention is not to exhaust the topic, but to seek in a clear and objective manner, through a bibliographic review, to discuss and reflect on this important subject, providing guidance for society and especially for the legislative and legal environment.
